Common questions.

What is the difference between a simple will and estate planning?
A simple will names who gets what. Estate planning asks the harder questions first — how your assets are actually held, what happens if a beneficiary predeceases you or cannot manage money, what tax your estate will face, who runs your business the week after you die, and whether probate can be reduced. The will is one document that comes out of that process, not a substitute for it.
Do I still need powers of attorney if I have a will?
Yes, and arguably sooner. A will only operates after death. Powers of attorney operate while you are alive but unable to act for yourself — the far more common scenario. Without them, your family may need a court-appointed guardianship to pay your bills or make health decisions, which is slow, public, and expensive.
What is a corporate will and do I need one?
A corporate will is a secondary will covering private company shares and related assets. In Ontario, assets governed by a secondary will can pass outside probate, which means Estate Administration Tax is not charged on that value. If you own shares in a private corporation, it is usually worth the conversation.
What is a Memorandum of Wishes?
It is a non-binding letter that sits alongside your will and guides your executor or trustee on how you would like discretion exercised — which personal items go where, how to weigh competing family circumstances, what you intended by a particular provision. Because it is not part of the will, it can be updated without redrafting anything.
When does a trust make sense?
Most often when a beneficiary needs protecting rather than simply paying — a child with a disability whose benefits could be affected by an inheritance, a young adult who should not receive a lump sum at eighteen, or a blended family where you want to provide for a spouse without disinheriting your children. Trusts also come up in tax and business succession planning.
